In order to build on the information that was obtained in the course of the first study, a follow-up survey was conducted first by phone and subsequently in a written form between August and October 2014. We contacted 1.858 hospitals in all of Germany for the follow-up survey by phone. In cases where a hospital had not participated in the first study, the willingness to participate in the follow-up survey was established in advance. The survey’s dispatch was ensured in the (...) case of acceptance. The same structured survey was used as a research tool. The data of the first study and the follow-up survey were merged and evaluated. 654 surveys could be evaluated altogether. Our survey by phone revealed that 912 hospitals in all of Germany have at least one form of clinical ethics consultation available. The health care ethics committee is the most frequently implemented structure of clinical ethics consultation. The implementation of clinical ethics consultation is dependent on sponsorship and hospital size. Recommendations to deliver structures of clinical ethics consultations have a smaller influence on the implementation compared to the certification by KTQ respectively proCum Cert. The rate of implementation in regard to the structures of clinical ethics consultation has steadily increased for years. The establishment of clinical ethics consultation in German hospitals should be further promoted. It would be desirable further to develop suitable juridical regulations in order to implement clinical ethics consultation as well as structural parameters. (shrink)

The executive board of the Academy for Ethics in Medicine and two AEM working groups formulated standards and recommendations for clinical ethics consultation in 2010, 2011, and 2013. These guidelines comply with the international standards like those set by the American Society for Bioethics and Humanities. There is no empirical data available yet that could indicate whether these standards and recommendations have been implemented in German hospitals. This desideratum is addressed in the present study. We contacted 1.858 German hospitals between (...) September 2013 and January 2014. A follow-up survey was conducted between October 2014 and January 2015. The data of the initial survey and the follow-up survey were merged and evaluated. The statements of the participants were compared with the standards and recommendations. The standards of the AEM concerning the tasks of clinical ethics consultation are employed by a majority of participants of the study. Almost all of these participants document their consultation activities by means of protocols or entries in the patient file. There are deviations from the recommendations of the AEM working groups regarding the drafting of statutes, activity reports, and financial support. The activities of clinical ethics consultation predominantly comply with the standards of the AEM and recommendations for the documentation. The recommendations for evaluation should be improved in practice. This applies particularly for activity reports in order to evaluate the activities. Surveys of the German public have revealed a high acceptance of social freezing, i.e. oocyte conservation without medical indication. Up to now, there are no investigations available on the experiences and attitudes of health professionals towards social freezing. Between August 2015 and January 2016, we surveyed gynecologists Germany-wide on the topic social freezing. Five gynecologists specialized in reproductive medicine and five office-based gynecologists in standard care were chosen for the survey. The survey was conducted with an explorative, qualitative research design. (...) The demand for social freezing in Germany is low. With regard to their fertility age, most women attend consultations too late, they have only little previous knowledge and false expectations. The gynecologists consider it the duty of society and politics to provide for the compatibility of family and work. They relate late parenthood to disadvantages primarily for the children. A majority of the gynecologists interviewed tend to advise natural reproduction. Social freezing is often mistaken as a kind of fertility insurance. Thus, it is necessary that physicians inform women early about the possibilities and limitations of social freezing. In the first place, social freezing is not a medical or medical-ethical topic. Women consider the method as a possibility to ensure the compatibility of family and work. This compatibility should be mostly perceived as a political topic. It cannot be a medical task to solve this issue. In fact, a debate in society as a whole is necessary that includes all relevant actors. (shrink)

Anhand historischer Quellen, die sich dem hermaphroditischen Körper zuwandten, darunter zahlreichen Abbildungen, diskutiert diese Studie die Entstehung von Geschlechtlichkeit, die Praktiken der Geschlechtseinschreibung in die Körper und die hiermit korrespondierenden Effekte. Dabei werden naturgeschichtliche, medizinische und juridische Diskurse des 15. bis 19. Jh.s analysiert. Die Hermaphroditen-Beschreibungen des 15. Jh.s, beispielsweise von Paracelsus, erschüttern durch das Fehlen der Definition von Intersexualität über die doppelte Anzahl der Geschlechtsteile, das Fehlen der modernen, wohlbekannten Verbindung von Hermaphrodit und Geschlecht die Vertrautheit unseres Wissens über (...) Hermaphroditen. Solch eine Verbindung taucht erstmals in den Hermaphroditen-Diskursen des beginnenden 17. Jh.s auf. Sie wird in jenen medizinischen Traktaten produziert, die nach der "Wahrheit des Geschlechts" hermaphroditischer Körper fragen. Und genau diese Frage ist es, die den Moment markiert, da im abendländischen Denken das Geschlecht erfunden wurde. (shrink)

In the GDR, women from the age of 12 onwards have been committed to closed venerology wards. The involuntarily committed had not been informed about the medical treatment on the wards; it was performed without their consent – impinging on their physical integrity. The closed venerology wards have been controlled by the Ministry of State Security. Unofficial employee reported to the Ministry on the medical personnel and on the patients on the wards. Due to this information the Ministry of State (...) Security knew at all times, what was taking place within the closed venerology ward in Halle and who was being compulsory admitted to this ward. The Ministry of State Security diversely used this information. Physicians were simultaneously involved as unofficial employees in operational processes against individual patients. (shrink)

Since 1989, clinical ethics consultation in form of hospital ethics committees was established in most of the transition countries of Central and Eastern Europe. Up to now, the similarities and differences between HECs in Central and Eastern Europe and their counterparts in the U.S. and Western Europe have not been determined. Through search in literature databases, we have identified studies that document the implementation of clinical ethics consultation in Central and Eastern Europe. These studies have been analyzed under the following (...) aspects: mode of establishment of HECs, character of consultation they provide, and their composition. The results show that HECs in the transition countries of Central and Eastern Europe differ from their western-European or U.S. counterparts with regard to these three aspects. HECs were established because of centrally imposed legal regulations. Little initiatives in this area were taken by medical professionals interested in resolving emerging ethical issues. HECs in the transition countries concentrate mostly on review of research protocols or resolution of administrative conflicts in healthcare institutions. Moreover, integration of non-professional third parties in the workings of HECs is often neglected. We argue that these differences can be attributed to the historical background and the role of medicine in these countries under the communist regime. Political and organizational structures of healthcare as well as education of healthcare staff during this period influenced current functioning of clinical ethics consultation in the transition countries. German medical schools have not yet sufficiently introduced students to the field of good scientific practice. In order to prevent scientific misconduct and to foster scientific integrity, courses on GSP must be an integral part of the curriculum of medical students. Based on a review of the literature, teaching units and materials for two courses on GSP were developed and tested in a pilot course. The pilot course was accompanied by a pre-post evaluation that assessed students’ knowledge and attitudes towards (...) scientific integrity and scientific misconduct. A syllabus was designed that comprised the following six topics: theoretical foundations of GSP; scientific publishing; empirical data; scientific supervision and teamwork; clinical research; personal interests. The comparison pre versus post-intervention yielded statistically significant changes in regard to the participants’ knowledge and attitude toward all forms of scientific misconduct treated in the course. As the majority of participants was not familiar with the fundamental regulations or guidelines of GSP, it seems crucial to train students in actively applying such norms to real-world conflicts. Students’ unfamiliarity with the fundamentals of GSP can be linked to the fact that many students have already experienced forms of scientific misconduct. Thus, GSP syllabi should be closely adjusted to a student’s realm of experience. All in all, courses on GSP can be seen as a potential means to increase the number of young scholars. (shrink)

Telemedicine is a complex field including various applications and target groups. Especially telehealthcare is seen by many as a means to revolutionize medicine. It gives patients the opportunity to take charge of their own health by using self-tracking devices and allows health professionals to treat patients from a distance. To some, this means an empowerment of patient autonomy as well as an improvement in the quality of care. Others state the dangers of depersonalization of medicine and the pathologization of daily (...) life. This paper examines the ethical implications of telehealthcare, focusing on patient autonomy and quality of care by analyzing metareviews, randomized controlled trials and narrative ethical analyses on the topic. As a result, we conclude that the technically enhanced encounter between patients and health professionals may mean an empowerment of patient autonomy when it goes along with a personal relationship based on trust, assistance and support. When it comes to the quality of care, telehealthcare may lead to an improvement as long it is adopted to the patient’s individual needs. (shrink)

German medical students are not sufficiently introduced to the ethical principles and pitfalls of scientific work. Therefore, a compulsory course on good scientific practice has been developed and implemented into the curriculum of medical students, with the goal to foster scientific integrity and prevent scientific misconduct. Students’ knowledge and attitudes towards GSP were evaluated by a pre-post-teaching questionnaire survey. Most participants initially had startling knowledge gaps in the field. Moreover, they were not acquainted with core institutions on GSP, the office (...) of ombudsperson and the nationally binding guidelines on GSP. The pre-post-teaching comparison showed statistically significant improvement in all areas tested; moreover, after the course participants confided more trust in GSP institutions. Applying ethical rules into practice can be challenging; therefore, students need to learn to work independently with guidelines on GSP and should be introduced to institutions providing further guidance. As our study has shown, students are very willing to pursue a scientific career based on integrity and honesty, however, they lack the knowledge how to do so. In light of our results, we therefore recommend to integrate courses on GSP already at an early time into the mandatory curriculum of medical students. (shrink)

Die Konzepte „Informationsmetabolismus“ von Antoni Kępiński und „Autopoiesis“ von Niklas Luhmann rekurrieren auf die Struktur biologischer Zellen. Beide Autoren übertragen diese biologischen Strukturen auf ihre jeweiligen Anwendungsfelder. Während Kępiński die Funktionsweise der Psyche zu bestimmen sucht, integriert Luhmann den biologischen Ansatz in seine Systemtheorie der lebenden und psychischen Systeme. Bei der Lektüre von Kępińskis und Luhmanns Arbeiten wird deutlich, dass beide Autoren das Verhältnis zwischen einerseits Psyche und andererseits psychischem System mit ihrer jeweiligen Umwelt näher bestimmen. In Luhmanns Werk ist (...) das Verhältnis zwischen System und Umwelt umfangreich beschrieben und ausgearbeitet. Vor diesem Hintergrund werden seine Ausführungen im Folgenden verwendet, um Kępińskis Überlegungen zum „Informationsmetabolismus“, dem Verhältnis von Psyche und Umwelt, zu reflektieren. (shrink)

Artikkelen drøfter hvordan vi bør forstå kravet om likhet for loven i Grl. § 98. Vi spør hvorvidt en appell til likhet for loven har selvstendig normativ funksjon, og eventuelt hvorfor og hva som kreves for at likhetskravets skal realiseres. Artikkelen tar utgangspunkt i et behov for avklaring av disse spørsmålene, da verken forarbeidene til grunnlovsrevisjonen i 2014 eller etterfølgende rettsvitenskapelig litteratur, i særlig grad avklarer hva likhet for loven betyr. Vi utvikler en teori om at likhetsprinsippet i § 98 (...) er et grunnprinsipp for retten som fastlegger begrunnelsesbyrden ved utformingen av lov og annen regulering, og ved rettsanvendelsen. Likhetsprinsippet innebærer at likebehandling krever i seg selv ingen begrunnelse, mens ulikebehandling må kunne begrunnes i henhold til kravene i andre ledd. De to leddene i paragrafen er derfor etter vårt syn uatskillelige: Første ledd stadfester hva som er utgangspunktet, mens andre ledd presiserer hva som ikke regnes som relevante begrunnelser for ulikhet. Likhetskravet er dermed ikke et krav om likt utfall, men et krav om likeverdighet, som vi hevder er en konstitutiv verdi for verdien av politisk rettferdighet. Den forståelsen av likhetskravet i § 98 som vi utvikler, knytter første og andre ledd i § 98 sammen, og åpner for at også første ledd kan bli mer aktivt brukt av domstolene. (shrink)

I denne artikkelen drøfter vi hvordan norske forbrukeres holdninger til genmodifisert mat har endret seg gjennom årene. Allerede da genteknologi ble etablert som et eget forskningsfelt og utviklingsområde på 1980-tallet, viste den norske opinionen stor skepsis. Den norske lovgivningen tidlig på 1990-tallet utmerket seg også som den mest restriktive i Europa. Dette bildet endret seg ikke mye i løpet av 1990-tallet, mens opinionen i mange europeiske land i disse årene kom mer på linje med den norske. I hele denne perioden (...) var både forbrukeropinionen og lovgivningen i USA langt mer aksepterende enn i Europa, noe som ga seg utslag i en handelskonflikt som toppet seg med EU sitt moratorium for utsetting av genmodifiserte planter i 1999. I denne artikkelen stiller vi spørsmålet om norske forbrukeres holdninger til genmodifisert mat har endret seg de siste årene. Artikkelen viser at mellom 2002 og 2007 er det en voksende gruppe av forbrukere som ser ut til å akseptere genmodifiserte matvarer hvis det fører til en helse- eller miljøgevinst. Men til tross for dette så er nordmenn fremdeles skeptiske til genmodifisert mat. Det kan tolkes slik at genmodifisert mat ikke har ført til den nytten som ansees nødvendig for å ta den risikoen det innebærer å gjøre et betydelig skifte i matseddel. Matpatriotisme og en kulturell konservatisme når det gjelder skifte i matvaner bidrar også til å forklare den dominerende vente-og-se-holdningen. (shrink)

I denne artikkelen drøfter jeg bruk av biomedisinsk teknologi i prestasjonsfremmende hensikt i konkurranseidrett. Mer presist utforsker jeg mulighetene for å skille mellom etisk akseptabel og etisk uakseptabel bruk. Jeg kritiserer WADAs normative grunnlag for å forby visse biomedisinske midler og metoder, og argumenterer for at eventuelle forbud må bygge på tydeligere verdisyn på idrett. Jeg undersøker to idealtypiske syn og deres teknologiske implikasjoner. Det smale synet er liberalt og avviser begrensninger i bruk av biomedisinske midler og metoder blant voksne (...) idrettsutøvere som dårlig begrunnet paternalisme. Det brede synet innebærer en mer restriktiv holdning og aksepterer en viss regulering av trening og prestasjonsutvikling også utenfor konkurransene. I en avsluttende del veier jeg det smale og det brede synet mot hverandre og reflekterer over hvilket syn som vil dominere framtidens idrett.Nøkkelord: etikk, idrett, biomedisinsk teknologi, dopingEnglish summary: The use of biomedical technology in sport: Are there any limits?In the article I examine the use of biomedical technology to enhance performance in competitive sport. More specifically I examine the possibilities for distinguishing between ethically acceptable and ethically unacceptable use of such technology. I criticize the World Antidoping Agency's normative criterion for banning certain technologies as it is vague and unclear. I argue that any ban by WADA has to build on a clear and operational normative view of sport. Two relevant ideal-typical views are examined together with their technological implications. The narrow view is liberal and rejects restrictions on the use of biomedical technology among professional athletes as unjustifiable paternalism. The wider view implies a more restrictive approach and accepts certain regulations of performance-enhancing means and methods outside of competitions. In the conclusion, I compare the narrow and the wider views and reflect upon their possible status in competitive sport in the future. (shrink)

Heldigvis kan teknologien hjælpe med at løfte sløret for, hvad der foregår, mens vi ligger og trækker torsk i land. Nogle drømme er dybt bizarre. Andre fører til Nobelpriser. Og så er der dem, som bare er pinlige. De sidste vil vi nødig sende i en hjernescanner. Artikkelen tar utgangspunkt i den norske idrettsmodellen der topp og bredde hører sammen, og der toppidrettsutøvere uvegerlig blir rollemodeller for barn og unge. Den moderne toppidretten er i økende grad preget av egoistiske holdninger der det dreier seg hele tiden om å skaffe seg fordeler. I denne artikkelen tar jeg opp egoisme, rettferdighet og sjenerøsitet som tre grunnleggende holdninger i idrettskonkurranser og drøfter hvorvidt man med inspirasjon fra sjenerøsitetsidealer og praktiske eksempler kan tenke seg en toppidrett som i større grad (...) bygger på sjenerøsitet. Artikkelen starter med en kort presentasjon av den norske idrettsmodellen og jeg skisserer deretter tre kriterier som alle idrettskonkurranser må oppfylle: 1) spille for å vinne, 2) klare regler som følges, og 3) respekt for konkurrenter. Deretter presenterer jeg egoisme, fairness og sjenerøsitet som tre mulige grunnholdninger, og de implikasjonene de har i en idrettslig sammenheng. Etter en gjennomgang av den grunnleggende egoismen i dagens toppidrett, som infiserer ikke bare utøveren, men også hele systemet rundt utøveren, diskuteres muligheten for å utvikle holdninger basert på sjenerøsitet. Det nevnes tre kilder til inspirasjon; engelsk overklassesport, Nietzsches tanker om den overlegne mester, og Arne Næss' sportspraksis og hans saklighetslære for gode diskusjoner. This means that elite athletes become role models for children and young athletes. However, modern elite sport is increasingly characterized by egoistic attitudes where the goal is to acquire advantages that the other athletes do not have. The article discusses egoism, fairness and generosity as three fundamental attitudes in sporting competitions and discusses whether it is possible to develop an elite sport that is based on generosity to a greater extent than now. The article starts with a presentation of the Norwegian sport model and then sketches three criteria that every sporting competition must fulfill, 1) play to win, 2) clear rules that must be complied with, 3) respect for fellow competitors and opponents. Then there is a delineation of egoism, fairness and generosity as three possible attitudes and the implications they have in the context of sport. Egoism seems to be the basic attitude in elite sport today and it infuses not only the athletes but the whole system around them. The article then looks into the possibilities for generosity in elite sport and draws inspiration from three quite different sources; 1) British upper-class sport in the 19th century, 2) Nietzsche's views of the superior and brilliant masters, and 3) the philosopher Arne Næss' sport philosophy and his rules for good academic debates. This is followed by empirical examples of generosity and a game theoretical illustration of the consequences of egoism and generosity. The conclusion is that a change in the direction of generosity will lead to a richer and more meaningful elite sport and provide a better basis for an organic sport model. (shrink)

At profesjonsutøvere er ansvarlige og har ansvar knyttet til arbeidet de utfører, tar vi nærmest for gitt. Mitt sikte med denne artikkelen er å gi et innspill til nærere drøfting av hvordan det profesjonelle ansvaret kan forstås. I nyere profesjonsetiske kodekser knyttes ansvar først og fremst til konsekvenser av handlinger. Det innebærer at den profesjonelles ansvar forutsetter at det kan trekkes en linje fra en handlings konsekvens til den handlende. I komplekse organisasjoner kan imidlertid rekonstruksjon av veien fra konsekvens av (...) handling tilbake til den handlende vise seg vanskelig. Alternativt kan ansvar knyttes til spørsmål om handlingens samsvar med regler og prosedyrer. En slik tilnærming benevnes gjerne som «accountability». Disse to ulike tilnærmingene til ansvar har det til felles at det er handlingen som er i fokus – handlingens regelsamsvar eller dens konsekvenser, ikke en individuell dimensjon knyttet til den handlende som person. Den profesjonelle som selvstendig, tenkende og vurderende person blir perifer. Til videre drøfting av dette trekker jeg veksler på Hannah Arendts tenkning om ansvar. «To-i-én-dialog» og «tenkning» er sentrale elementer, og jeg vil peke på hennes bidrag som en mulig vei til en utdypet forståelse av det profesjonelle ansvarets individuelle dimensjon.Nøkkelord: profesjonelt ansvar, handlingens konsekvenser, accountability, to-i-én-dialog, tenkningEnglish summary: Individual responsibility and shallowness in professional workIt is almost taken for granted that professionals are responsible for the work they do. The scope of this article is to contribute to an evaluation of how we can understand this professional responsibility. Modern professional–ethical codes tie responsibility primarily to the consequences of acts. Thus the responsibility of a professional assumes that a connection can be drawn between the consequences of an act to the person who acted. However, in complex organizational structures, it can be difficult to find the path from consequence to actor. Another option is to look at responsibility as the product of an action's compliance with rules and procedures. Such an approach is often called «accountability». What these two different approaches to responsibility have in common is the focus on an action. It is the consequences of acts or compliance of rules that matter rather than the individual who performs the act. The idea of a professional as an autonomous, thinking and evaluating person becomes peripheral. The individual dimension of responsibility involves that the professional's responsibility goes beyond adherence to rules and procedures and what follows from tracking acts and consequences. I use Hannah Arendt's thoughts on the responsibility to facilitate further debate on this topic. A «two-in-one» dialogue and «thinking» are core elements in this, and I will point to her contribution as a possible path to a more in-depth understanding of the individual dimension of professional responsibility. I denne teksten blir følgende spørsmål tatt opp til drøfting: Er det å ta medisinsk teknologi i bruk for å selektere et døvt barn mer etisk problematisk enn det motsatte; å bruke teknologien for å sikre seg et hørende barn? På bakgrunn av fire premisser konkluderer jeg med at både seleksjon for døvhet og for hørsel er tilnærmet like etisk problematisk. De fire premissene er 1) at seleksjonskriteriet sykdom eller skade bør erstattes av autentisitetsbetraktninger, 2) at døve og hørende har (...) samme potensial for autentisk livsutfoldelse, selv om det ikke kan avvises at døvhet kjennetegnes ved manglende hørsel, 3) at seleksjon innebærer fravalg av liv som har autentisk potensialitet enten som døv eller hørende, og 4) at dette fravalget involverer en etisk kostnad. Konklusjonen har enkelte andre implikasjoner og en restproblematikk som belyses avslutningsvis. (shrink)

Filosofi og pædagogik er gamle fæller, og der er et overlap mellem filosofiens historie og pædagogikkens historiske litteratur. Store tænkere som Platon, Aristoteles, Augustin, Descartes, Locke, Rousseau, Kant, Hegel, Schleiermacher, Herbart og Dewey hører hjemme begge steder. I den pædagogiske filosofi kan almene teoretiske og praktisk filosofiske spørgsmål udforskes systematisk og historisk. Gennem diskussioner af sådanne spørgsmål kan man forholde sig mere nysgerrigt, bevidst, begrundet og kritisk til pædagogisk praksis såvel som til pædagogisk teori, empiri og undervisningsteknologi. -/- Fællesskabet er (...) ikke uproblematisk. Pædagogik er ikke filosofi, og pædagogisk filosofi ikke kun pædagogik. Både didaktik og almen pædagogik kan komme i konflikt med pædagogisk filosofi. Hvordan kan almene pædagogiske spørgsmål overhovedet belyses filosofisk, og hvad betyder de for filosofien selv? En pædagogisk filosofisk tilgang forandrer kanon i både pædagogik og filosofi. Udvalget af nøgletekster ændres. Emner, der er værd at diskutere, forskydes. Nye forskningsspørgsmål og prioriteringer viser sig. Et pædagogisk perspektiv på filosofiens udvikling vil fremhæve dens bidrag til at forstå ’den pædagogiske problem- og fænomenverden’, ligesom et filosofisk perspektiv på pædagogikken vil flytte – eller rettere udvide – fokus med hensyn til dens idéhistorie såvel som dens aktuelle teoretiske praksis. Som i al anden filosofi kan man i den pædagogiske filosofi diskutere teoretiske og praktiske, såvel som poetiske og æstetiske spørgsmål; men det er typisk med en særlig vinkel, nemlig den pædagogiske. Man kan således diskutere erkendelse, viden og sandhed, ligeså vel som man kan undersøge ret, retfærdighed og skønhed. Ofte vil det være med en særlig tvist. Den pædagogiske filosofi kan vise sig som særegen både ved sin særlige position og ved at relatere sig til det pædagogiske som genstandsfelt. Hvad denne position og dette genstandsfelt egentlig er, er der dog ingen enighed om. Det kan ikke engang siges at være udelukkende pædagogisk defineret, og derfor må den pædagogiske filosofi forholde sig åbent til begge dele. IT is a curious fact that more books on J. H. Newman have been written by foreign than by English authors, as A. R. Vidler remarks in a book review in the Philosophical Quarterly. He adds a number of reasons all of which have exercised a certain influence. He suggests the main reason to be that Newman “is naturally attractive and useful to Roman Catholics who are disposed to explore lines of thought that deviate from, or are not covered by, (...) scholasticism or Thomism.” We cannot quite agree with this suggestion. First of all it is not borne out by historical facts. Most of the earliest writings on Newman in the Netherlands were actually written by non-Catholics, mainly by Protestants of widely-different denominations. One of the first was Allard Pierson who wrote a lengthy biographical sketch in the same year as Newman died, and others brought out or used various parts of Newman’s teaching long before any Catholic publication—except for an occasional article—was printed. So we find J. W. Moll, Rector of the University in Groningen, making full use of Newman’s Idea of a University in an official address to the University as early as 1910, whilst H. Stoel, Minister of the Dutch Reformed Church, offered a work on Newman to the same University in order to obtain the Doctorate of Divinity in 1914. There are other important works on Newman’s doctrine by two non-Catholics, who were later converted to the Roman Catholic Church, viz., one by W. H. v.d. Pol, who wrote on the Idea of the Church in Newman’s Life and Thought, and one by Prof. Dr. De Vogel on his doctrine of justification. Both these works excel in bringing home to the reader Newman’s own method of thought because they make us listen to that great Christian, and enable us to take in his way of contemplating reality, so that we acquire something of that mentality which Newman himself called: the true philosophical temper. In none of these works do we find the slightest indication that the authors were desirous of using Newman because he had deviated from the path trodden by traditional scholasticism. These authors wrote about him because they felt that to be true which Pierson had already testified: “Nobody can neglect him without suffering a sensible loss.”. (shrink)

Lehren und Lernen, verstanden als komplexe Vermittlung und Verarbeitung von Inhalten, finden immer in räumlichen Kontexten statt, die hinderlich oder förderlich sein können. Diese Räume können von ganz verschiedener Art sein und sie müssen sich keineswegs auf den Hörsaal und Seminarraum beschränken. Der Sammelband, der aus zwei Symposien des Münchner-Dozierenden-Netzwerks in den Jahren 2020 und 2021 hervorgegangen ist, möchte diese Räume erkunden, medial reflektieren und zugleich neue Räume für die Lehre eröffnen. Business ethics and firm economic performance have traditionally often been regarded as mutually exclusive ends. We challenge this “either-or” belief and analyze when and how ethical firm leadership and firm performance may harmonize well. In extension of earlier research on ethical leadership and performance at the individual and team level, we study the context–dependency of the organization level relationship between CEO ethical leadership and firm performance. We propose a moderated mediation model of the link between CEO ethical leadership and firm (...) performance, identifying mediating and moderating variables unique to the organization-level of analysis. CEO ethical leadership is argued to work through organizational ethical culture which promotes firm performance under the condition that there is a strong corporate ethics program in place. Results from a multisource cross-sectional study, in which we surveyed 145 participants from 32 organizations and validated organizational performance ratings by objective performance data, showed support for our conceptual model. The central claim of this book is that I is a deictic term, like the other singular personal pronouns You and He/She. This is true of the logical character, inferential role, referential function, expressive use, and communicative role of all and only expressions used to formulate first-personal reference in any language. The first part of the book shows why the standard account of I as a ‘pure indexical’ (‘purism’) should be rejected. Purism requires three mutually supportive doctrines which turn out (...) to be myths: a) that a simple rule is sufficient to give the meaning of I (‘rule theory’); b) that one can use I to express thoughts without having to identify what is being referred to (‘independence’); and c) that as a matter of the meaning of I, any use of the term is logically guaranteed against failure to refer (‘the guarantee’). The second part of the book shows why the radically new account of I should be endorsed as a deictic term. Substitution instances and the behaviour of I in inference reveal that it has an obligatorily deictic logical character and inferential role. I fulfils its referential function in the deictic way, providing determinacy of reference by making an individual referentially salient in the extra-sentential context. The discriminability of the referent of an I-use depends on recognizing the referentially salient individual. This is true of its discriminability both to the reference-maker and to the audience. So I has the expressive use and communicative role of a deictic term. The conclusion of the book directs research towards the next step, showing how the meaning of I may be used to elucidate the thoughts expressed by the term, and from there questions relating to self-knowledge, practical reasoning, belief-acquisition, and belief-ascription. John McDowell has set the philosophical world alight with arevolutionary approach to the subject, illuminating old problemswith dazzling particularity. In this welcome introduction to hiswork, Maximilian de Gaynesford puts writing within comfortablereach of non-specialists. The guiding argument of the book is that the variety of McDowell'sinterests disguises a core concern with a single basic goal:'giving philosophy peace'. Since the dawn of the subject,philosophy has struggled with the question: can our experience ofthe world give rational support to what we think (...) and say; and ifso, how? McDowell claims that philosophy has itself to blame ifthese questions seem problematic, and this book's animating purposeis to see what sense can be made of this notorious claim. InMcDowell's view, the illusion that our fundamental relations withthe world are truly problematic is traceable to false views aboutnature. We should give proper weight to a natural fact about theworld: that human beings are of a kind that is naturally placedwithin the natural order. Building on group discussions and interviews with life science researchers in Austria, this paper analyses the narratives that researchers use in describing what they feel responsible for, with a particular focus on how they perceive the societal responsibilities of their research. Our analysis shows that the core narratives used by the life scientists participating in this study continue to be informed by the linear model of innovation. This makes it challenging for more complex innovation models [such as responsible research and (...) innovation ] to gain ground in how researchers make sense of and conduct their research. Furthermore, the paper shows that the life scientists were not easily able to imagine specific practices that would address broader societal concerns and thus found it hard to integrate the latter into their core responsibilities. Linked to this, researchers saw institutional reward structures as strongly focused on scientific excellence. Thus, they saw reward structures as competing with—rather than incentivising—broader notions of societal responsibility. This narrative framing of societal responsibilities is indicative of a structural marginalisation of responsibility practices and explains the claim, made by many researchers in our sample, that they cannot afford to spend time on such practices. The paper thus concludes that the core ideas of RRI stand in tension with predominant narrative and institutional infrastructures that researchers draw on to attribute meaning to their research practices. This suggests that scientific institutions still have a core role to play in providing new and context-specific narratives as well as new forms of valuing responsibility practices. (shrink)

This paper discusses ἐπιβολαὶ τῆς διανοίας, which later Epicureans are supposed to have elevated to a fourth criterion of truth to complement perceptions, preconceptions and feelings. By examining Epicurus’ extant writings, the paper distinguishes three different senses of the term: ‘thought in general’, ‘act of attention’ and ‘mental perception’. It is argued that only the sense ‘mental perception’ yields a plausible reading of ἐπιβολαί as a criterion of truth. The paper then turns to the textual evidence on ἐπιβολαί in later (...) authors. While the term ἐπιβολή is not used by Cicero, Lucretius and Philodemus in the sense of mental perception, it is argued that this still is the most plausible way of understanding ἐπιβολή as a criterion of truth. Gibt es kulturelle Unterschiede oder einen Bedeutungswandel hinsichtlich der curiositas? Was sind die bevorzugten Gegenstandsbereiche der theoretischen Neugier? Hierbei prallen zwei Einstellungen aufeinander: die curiositas als fehlgeleitete und im Grunde eitle und schädliche Neugier oder als ein Naturverlangen, das ein anthropologisches Existential darstellt. Ausgehend vom Wortfeld der theoretischen Neugierde wird die Dialektik und longue durée (...) der curiositas in ihren historischen und systematischen Zusammenhängen thematisiert. An die Stelle von normativen Wertungen treten zeitlich und räumlich weitgespannte Untersuchungen, die dazu beitragen, die begriffliche, motivische und konzeptionelle Entfaltung der theoretischen Neugier im Spannungsfeld theoretischer, kultureller, institutioneller und religiöser Determinanten zu verfolgen und damit zugleich aus der epochenfixierten Engführung zu befreien. Description: The common western understanding of Buddhism today envisions this major world religion as one of compassion and tolerance. But as the author Droit reveals, this view bears little resemblance to one broadly held in the nineteenth-century European philosophical imagination that saw Buddhism as a religion of annihilation calling for the destruction of the self. The Cult of Nothingness traces the history of the western discovery of Buddhism. In so doing, the author shows that such major philosophers as Schopenhauer, Nietzsche, (...) Hegel, Cousin, and Renan imagined Buddhism as a religion that was, as Nietzsche put it, a negation of the world. In fact, says the author, such portrayals were more a reflection of what was happening in Europe at the time-when the collapse of traditional European hierarchies and values, the specter of atheism, and the rise of racism and social revolts were shaking European societies-than an accurate description of Buddhist thought. The author also reflects on how this history continues to echo in contemporary western understanding of Buddhism. If philosophy and poetry are to illuminate each other, we should first understand their tendencies to mutual antipathy. Examining mutual misapprehension is part of this task. J. L. Austin's remarks on poetry offer one such point of entry: they are often cited by poets and critics as an example of philosophy's blindness to poetry. These remarks are complex and their purpose obscure—more so than those who take exception to them usually allow or admit. But it is reasonable to think that, (...) for all his levity at their expense, what Austin offers poets is exemption from forms of commitment. Since such exemption is precisely what poets and critics have sought, this diagnosis is eirenic. This exemption has a price, but it may be affordable. (shrink)

The ability to reason independently from one's own goals or beliefs has long been recognised as a key characteristic of the development of formal operational thought. In this article we present the results of a study that examined the correlates of this ability in a group of 10-year-old children ( N = 61). Participants were presented with conditional and relational reasoning items, where the content was manipulated such that the conclusion to the arguments were either congruent, neutral, or incongruent with (...) beliefs, and either logically valid or logically invalid. Participants also received a measure of working memory capacity (the counting span task) and a measure of inhibitory control (the stop signal task). Indices of belief bias and logical reasoning on belief-based problems were predicted independently by both measures. In contrast logical reasoning on belief neutral problems was predicted by working memory alone. The findings suggest that executive functions play a key role in the development of children's ability to decontextualise their thinking. (shrink)

Based on certain passages in Colotes, Hermarchus, and Horace, the Epicureans may be thought to defend a social contract theory that is roughly Hobbesian. According to such a view, human life without the social contract is solitary and brutish. This paper argues that such a reading is mistaken. It offers a systematic analysis of Lucretius’s culture story in On the Nature of Things v as well as the Epicurean passages that at first sight seem to contradict the Lucretian account. The (...) conclusion of such an analysis is not only that all extant evidence is internally consistent, but also that Epicurean social contract theory relies on a ‘dynamic’ conception of human nature: On the Epicurean view, agents have very different psychological motivations when coming together to form societies and when coming together to form political and legal states. COVID-19 severity and mortality risk are greater for older adults whereas economic impact is deeper for younger adults. Using the Health Belief Model as a framework, this study used a web-based survey to examine how perceived COVID-19 susceptibility and severity and perceived efficacy of recommended health behaviors varied by age group and were related to the adoption of health behaviors. Proportional odds logistic regression was used to examine the relationship between age group and perceived COVID-19 susceptibility, severity, impact, and health (...) behavior efficacy and adoption. Structural equation modeling based on HBM constructs examined the relationships between health beliefs and behaviors. Data from 820 participants were analyzed. Middle-aged and older adults reported greater concerns about the personal risk of hospitalization and mortality, economic impact, and social impact of COVID-19 than young adults. Middle-aged adults also reported greatest concern for other age groups. Adoption and perceived efficacy of health behaviors was similar across age groups with few exceptions. Both middle-aged and older-adults were more likely to perceive their own and each other's age groups as responding adequately to COVID-19 compared to young adults. Structural equation modeling indicated perceived benefits of health behaviors were the primary driver of behavior uptake, with socioeconomic factors and perceived severity and susceptibility indirectly associated with uptake through their influence on perceived benefits. Overall, these results suggest adoption of health behaviors is very high with few differences between age groups, despite differences in perceived impact of COVID-19. Public health communications should focus on the benefits of health behaviors to drive adoption. (shrink)
